Who is responsible for damage caused by fallen scaffolding?

Trees falling on cars is one thing, but there was a lot of storm damage caused by contractors not properly securing their shit.

On 8th Ave near Garfield, a bucket and pulley fell off a building and smashed a car. And up on Prospect Park West, a bunch of scaffolding rained down from a tall apartment and fell across the entrance (and car) of the building next door.  This could have killed people.

Should these building owners or construction companies be investigated or fined for negligence?
